1. On condition that you follow these terms, we grant you a non-exclusive, non-transferable right to use the Software.

2. Free Software may be used free of charge by individuals and companies. Paid Software (such as SwiftSyncExp and SwiftSyncProX) may be used per PC under Article 6.

3. Copyright and all other rights in the Software belong to us (or the rightful owners). You receive only a right to use it; the Software itself is not sold to you.

1. copy, distribute, sell, lend or publish the Software without our permission (linking to our website is welcome);

2. modify, disassemble, decompile or reverse-engineer the Software, except where the law permits;

3. remove or circumvent limits on the period of use or number of PCs, copy protection, signature checks or similar mechanisms;

4. use the Software against the law or public order, or to infringe the rights of others (copyright, portrait rights, privacy, etc.);

5. enter, view or control another person's PC, server, account, screen, files or communications without the permission of their owner or user (use features such as "view/control the screen" and "other PCs" in SwiftSyncProX only within the permission you have);

6. send unwanted faxes or email (such as advertising the recipient did not ask for);

7. cause damage or nuisance to us or others, or harm our reputation.

1. The Software is provided "as is". We do not warrant that it is free of errors, runs without interruption, fits a particular purpose, works with your PC, devices, other software or services, or does not infringe the rights of others.

2. We may change, update, or stop distributing or providing the Software without notice.

3. External services used by the Software (internet servers, AI and other services of Google, Microsoft, OpenAI, Anthropic and others, fax lines, routers, etc.) are governed by their own terms. We are not responsible if the Software cannot be used because they change or stop.

We accept no responsibility whatsoever, whatever the cause, for any disadvantage or damage to you or third parties arising from using or being unable to use the Software (for example, loss or overwriting of files or data, broken or unavailable websites, faxes or email sent in error, not sent or not delivered, failure or malfunction of PCs or devices, leaks of information, interruption of business, lost profits, or disputes with others).

2. Always back up important files and data yourself before using the Software. Even where the Software has a backup feature, we do not guarantee that the backup will be kept.

3. We do not guarantee that information, AI answers, conversion results or notices produced by the Software are correct or up to date. Check important matters yourself before deciding.

4. If the law does not allow all of our liability to be excluded, our liability, except in cases of our intent or gross negligence, is limited to ordinary damage actually suffered by you, up to the amount you paid us for that Software (zero for free Software).

1. Some Software checks automatically for new versions and tells you about them. These terms also apply to new versions you install.

2. Updates may change the look, usage or features.

1. Paid Software is free for a 30-day trial from the day it is first started. After that it is paid per PC per year (prices are shown on our website). You can choose either way of paying:

(1) Pay each time: you pay for one year when you complete the payment yourself. Nothing is charged automatically. One month before the end date we notify you in the Software and at the email address you gave us; the notice includes information on automatic renewal and how to stop it.

(2) Automatic renewal: if you choose "Automatic renewal" at the first start or in the Software's license window and complete the payment steps, one year is charged to your registered payment method on the current end date (the end of the trial, if in the trial) and then every year on the same day. You can choose it before the renewal time. You can stop it at any time with "Stop automatic renewal" in the Software's license window; if you stop it by the day before the next charge date, no further charge is made, and you can keep using the Software until the current end date.

2. If the trial is about to end before we start accepting payment, we may extend the trial by one month at our discretion.

3. If the period of use ends and the expired window is closed without payment, the Software (the program file and its shortcuts) is automatically removed from the PC as a safeguard. Your settings such as connections remain; if you reinstall, the payment page opens at once and, after payment, you can use it as before.

4. In the unlikely event that we cannot start accepting payment, the service ends at the end of the period of use and the Software is removed from the PC. In that case you will not be asked to pay.

5. Fees paid are not refundable except where required by law. Payment is handled through payment companies we use (such as Stripe).

1. Information we receive

(1) PC ID: to check the period of use and prevent copying, a number derived from PC information (which cannot be turned back into the original) is sent to our server. It does not include your name or address.

(2) Software version, Windows version, etc.: sent when the Software asks our server about new versions.

(3) Bug and feedback reports: only when you press "Report", the text you wrote, diagnostic information (Software version, Windows version, activity log; server names, user names and passwords are hidden) and, if you entered it, your email address are sent. You can review the contents on screen before sending.

(4) Payment information: name, email address and payment records (card numbers are handled only by the payment company; we do not receive them).

(5) Download counts: only the number of downloads on our website is counted.

(6) Usage counts: some Software (such as the in-office LAN games) tells our server how many times it was used, without your name.

2. Purposes

Only for providing the Software, checking the period of use and payment, sending renewal and automatic-renewal notices, telling you about new versions, fixing and improving the Software, answering enquiries, and responding when required by law.

3. No disclosure to third parties

We do not give it to third parties without your consent, except where permitted by law or where needed to protect life, body or property and consent is hard to obtain. We may entrust payment processing, server operation, etc. to outside companies, and we supervise them properly.

4. Information kept on your PC

Connections, passwords, settings, send/receive records and backups are stored on your PC (passwords in a form readable only on that PC). We do not receive them. Delete them yourself when you dispose of the PC.

5. Parties you choose to connect to

Information sent to parties the Software connects to at your instruction (your website server, GitHub, other PCs, fax recipients, AI services such as Google, OpenAI and Anthropic, your Google account, etc.) is governed by their terms. Text you enter is sent to the AI service (the AI service key is stored only on your PC). "Kininaru" sends the names and words you enter to search services such as Google, Bing, Hatena and Wikipedia. Communication between SwiftSyncProX PCs (files, screens, video meetings, etc.) is encrypted and does not pass through our server. The name you enter in the in-office LAN games is shown on the screens of other players on the same LAN.

The Software may read the following information on your PC, but does not send it to us: connections saved by other FTP programs (on the first start of the SwiftSync family, to save typing), files you specify (such as the customer table in "Map QR Search"), and the state of your PC (such as "PC Health Check" and "PC Comfort Tool").

6. Security

We take necessary and appropriate measures to prevent leaks, loss or alteration of information we receive, and delete it after a set period when no longer needed.

7. Requests for disclosure, correction or deletion

To ask for disclosure, correction, suspension of use or deletion of your information that we hold, contact us below. After confirming your identity we respond according to the law.
